Terms of Use

1. Acceptance of Terms

By accessing or using Text Back Genius ("Service"), operated by AiFFEX, LLC ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms in their entirety, you must immediately cease all use of the Service.

2. Eligibility

You must be at least 13 years of age to use the Service. By accessing the Service, you represent and warrant that you meet this minimum age requirement. Users between 13 and 17 years of age represent that they have obtained parental or guardian consent prior to use.

3. Entertainment Purposes Only

THE SERVICE IS PROVIDED FOR ENTERTAINMENT PURPOSES ONLY. All content generated by the Service — including but not limited to text decodes, tone analyses, intent summaries, warning flags, dating stage assessments, reply suggestions, and any other output produced by the Service ("AI Content") — is intended solely for entertainment. It is not intended to be relied upon as accurate, complete, factual, or suitable for any particular purpose.

By using the Service, you expressly acknowledge that you understand and accept this entertainment-only limitation.

4. AI-Generated Content Disclaimer

The Service employs artificial intelligence technology to analyze text and generate responses. By its very nature, AI technology can and does produce content that may be:

  • Inaccurate, incorrect, or factually wrong
  • Incomplete, lacking context, or misleading
  • Entirely fabricated or otherwise unreliable
  • Inconsistent from one use to the next
  • Not reflective of reality, intent, or actual meaning

AiFFEX, LLC makes no warranty, representation, or guarantee — express or implied — regarding the accuracy, reliability, timeliness, or completeness of any AI Content generated through the Service. You acknowledge and accept that AI Content may be partially or entirely wrong. AI can make mistakes.

All Decodes and Reply suggestions must be understood to be AI-generated content that may contain mistakes, errors, or be completely inaccurate.

5. No Professional Advice

THE SERVICE DOES NOT PROVIDE — AND IS NOT A SUBSTITUTE FOR — PROFESSIONAL ADVICE OF ANY KIND. AiFFEX, LLC expressly denies any suggestion, implication, or inference that the Service functions as, or should be relied upon as, any of the following:

  • A mental health counselor, therapist, or psychological service
  • A relationship advisor, coach, or expert
  • A psychologist or psychiatrist
  • A legal representative, attorney, or legal advisor
  • A medical professional or health clinician
  • A communications expert or specialist
  • Any other form of professional, certified, or licensed advisor

Nothing in the AI Content constitutes professional advice of any kind. You should not make important personal, professional, medical, legal, financial, or relationship decisions based solely on AI Content generated by this Service.

6. User Responsibility for Generated Replies

Any replies, messages, or communications that you choose to generate using the Service, and any decision to send, share, modify, or otherwise use such generated content, are made entirely at your own discretion and are your sole responsibility.

AiFFEX, LLC and Text Back Genius:

  • Exercise no control over what you choose to send or share
  • Make no directive or recommendation that you send any particular message
  • Assume no responsibility or liability for any consequences — personal, professional, legal, emotional, or otherwise — arising from your decision to use, send, or share generated replies
  • Are not affiliated with, and bear no responsibility for, any outcomes resulting from communications you choose to transmit

The use of generated replies in no way reflects upon, and shall not be attributed to, AiFFEX, LLC or Text Back Genius.

7. Account Registration

Certain features of the Service require account registration. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.

8. Subscriptions and Payments

Paid subscription tiers are billed through Stripe, Inc. All subscription fees, billing cycles, and applicable taxes are disclosed at the time of purchase. Subscriptions renew automatically unless cancelled prior to the renewal date. We reserve the right to modify pricing upon reasonable notice to subscribers.

9. Prohibited Conduct

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law
  • Attempt to reverse-engineer, exploit, or compromise the Service or its infrastructure
  • Submit content that violates third-party intellectual property or privacy rights
  • Use the Service to facilitate harassment, threats, or harm to any person
  • Attempt to circumvent any access controls or usage limitations

10. Intellectual Property

All content, branding, software, design, and technology comprising the Service are owned by or licensed to AiFFEX, LLC and are protected by applicable intellectual property laws. Nothing in these Terms grants you any ownership interest in the Service.

11. Hold Harmless & Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU AGREE TO HOLD HARMLESS, INDEMNIFY, AND RELEASE AIFFEX, LLC, ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, AGENTS, LICENSORS, AND SERVICE PROVIDERS FROM AND AGAINST ANY AND ALL CLAIMS, LIABILITIES, DAMAGES, LOSSES, COSTS, AND EXPENSES (INCLUDING REASONABLE ATTORNEYS' FEES) ARISING OUT OF OR IN ANY WAY CONNECTED WITH:

  • (a) Your access to or use of the Service
  • (b) Your use, sending, modification, or sharing of any AI-generated content
  • (c) Your violation of these Terms
  • (d) Your reliance on any AI Content for any purpose
  • (e) Any third-party claim arising from your use of the Service

IN NO EVENT SHALL AIFFEX, LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES OF ANY NATURE, REGARDLESS OF THE CAUSE OF ACTION OR THEORY OF LIABILITY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO US IN THE THREE (3) MONTHS PRECEDING THE CLAIM.

12. Dispute Resolution — Mitigation Required

BEFORE INITIATING ANY FORMAL PROCEEDING, you agree to contact AiFFEX, LLC at legal@textbackgenius.com and attempt in good faith to resolve any dispute through informal negotiation and mitigation for a minimum period of sixty (60) days from the date of written notice.

If informal resolution is unsuccessful, any remaining dispute shall be submitted to binding arbitration, not litigation. You expressly waive any right to file a lawsuit or legal action in any court against AiFFEX, LLC arising from or related to your use of the Service.

13. Governing Law

These Terms shall be governed by and construed exclusively in accordance with the laws of the State of Wyoming, without regard to its conflict of law principles.

14. Modifications

We reserve the right to modify these Terms at any time. We will provide notice of material changes via email or prominent notice on the Service. Your continued use of the Service following any modification constitutes your acceptance of the revised Terms.

15. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for conduct that we determine, in our sole discretion, violates these Terms or is harmful to other users, us, or third parties.
